This appeal coming on for hearing on this day and upon perusing the grounds of appeal and order of the Lower Court and the material paper in this case and upon hearing the arguments of Mr.N.Manokaran, counsel for the appellant and of M/s.R.Sree Vidhya, counsel for the respondent No.3 and none appeared either in person or by an advocate on behalf of the 2nd respondent, this Court while dismissing the Civil Miscellaneous Appeal doth order and decree as follows:
