3. On being satisfied with the averments stated in the affidavit filed in support of the petition and the submissions made by the learned counsels on both sides, this petition is allowed.

4. Registry is directed to carry out necessary amendment in the cause title with regard to the death of the 3rd respondent in S.A.No.2150 of 2004, if the papers are otherwise in order.
