ORDER

This petition has been filed to withdraw H.M.O.P.No.23 of 2024 from the file of the Subordinate Court, Alandur, Chennai and transfer the same to the file of the Family Court, Karaikal, to be tried along with H.M.O.P.No.33 of 2024.

The learned counsel appearing for the petitioner would submit that the petitioner/wife filed a petition before the Family Court, Karaikal, for divorce on the ground of cruelty. While that being so, the respondent/husband filed a petition in H.M.O.P.No.23 of 2024 seeking restitution of conjugal rights before the Subordinate Court, Alandur. He would further submit that the respondent/husband was set ex parte in H.M.O.P.No.33 of 2024 and upon hearing the arguments of the learned counsel for the petitioner, the Family Judge, Karaikal, vide order dated 20.05.2025, has granted the decree of divorce and therefore, nothing survives for adjudication in this case. He would further submit that since this Court, vide order dated 20.01.2025, has granted an order of interim stay, the Subordinate Judge, Alandur, is unable to proceed further in H.M.O.P.No.23

of 2024.

In view of the submissions made by the learned counsel appearing for the petitioner and subsequent developments in the case, nothing survives for adjudication in this petition. The learned counsel for the petitioner also produced a copy of the order dated 20.05.2025 passed in H.M.O.P.No.33 of 2024 on the file of the Family Court, Karaikal, before this Court.

Hence, this transfer civil miscellaneous petition is closed. The personal appearance of the petitioner/wife is dispensed with for the present. The petitioner/wife shall appear before the Subordinate Court, Alandur, as and when her personal appearance is required. No costs. Connected C.M.P. is closed.
