O R D E R

This Criminal Original Petition is filed seeking direction upon the learned Judicial Magistrate No.V, Coimbatore, to complete the trial in C.C.No.18 of 2003, within a stipulated time. 2.

This Court, by order, dated 29.01.2015, called for report from the aforesaid Magistrate regarding the progress of the case in C.C.No.18 of 2003, pending on his file. Pursuant to the said order, the learned Magistrate has sent a report, dated 09.02.2015, stating that the case in C.C.No.18 of 2003, was adjourned from 2007 onwards on the ground that Criminal Original Petition No.7502 of 2005, filed by the accused to quash the proceedings in C.C.No.18 of 2003 was pending and stay was granted. The learned Magistrate has also stated that on scrutiny of records, he found that the stay granted in Crl.O.P.No.7502 of 2005, was dismissed on 16.07.2008. Unfortunately, without looking into the dismissal of Crl.O.P.No.7502 of 2005, successive Judicial Magistrate No.V, adjourned the case mechanically, on the premise that Crl.O.P.No.7502 of 2005 is pending, wherein, the stay has been granted.

In view of the abovesaid report, 09.02.2015, and the explanations contained therein, this Criminal Original Petition is disposed of, by directing the Judicial Magistrate No.V, Coimbatore, to dispose of the case in C.C.No.18 of 2003, pending on his file, within a period of two months from the date of receipt of a copy of this order.
