2. Sulochana W/o.Harikrishna ..Respondents/Respondents This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.S.Ramesh Babu, learned counsel appearing for the appellant/Insurance Company and Mr.M.Balaji, learned counsel appearing for the first respondent.
TERMS OF SETTLEMENT Though the Insurance Company has taken up the plea regarding the liability in view of the recent judgement of the Hon'ble Supreme Court with reference to the endorsement made in the driving licence, the Insurance Company seeks permission of this Court to withdraw this Civil Miscellaneous Appeal and made an endorsement to that effect.
2. Hence, this Civil Miscellaneous Appeal is dismissed as withdrawn. The claimants are permitted to withdraw the entire amount that has been deposited by the Insurance Company. Consequently, connected miscellaneous petition is closed. This Lok Adalat award is passed in terms of the above settlement.
The Court fee paid shall be refunded to the parties in the manner provided under the Court Fees Act, 1870 as provided for under Sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994. Judge Member Member New India Assurance Co. Ltd., Moore Street, Chennai-1.
