This Civil Miscellaneous Appeal is filed against the Judgment and Decree dated 22.04.2010, made in M.C.O.P.No. 539 of 2008, on the file of Motor Vehicles Accidents Claims Tribunal, Principal District Court, Namakkal.

2.When the matter was called on 05.02.2019 there was no representation for both the sides. Hence, the Registry was directed to list the matter on 07.02.2019 under the caption "for Dismissal". Even today(i.e) on 07.02.2019 when the matter was called there was no representation for the appellant therefore, this Appeal is dismissed for non prosecution. No costs.
