This Miscellaneous petition is filed to modify the condition imposed on the petitioner by this Court in Crl.O.P.No.30966 of 2022, dated 15.12.2022 by which the petitioner was directed to deposit Rs.1,50,000/- at Mediation and Conciliation Centre Dharmapuri.

2.The learned counsel appearing for the petitioner submitted that on earlier occasion, this Court modified the condition to deposit Rs.1,50,000/- at Mediation and Conciliation Centre, Dharampuri, instead of deposit Rs.3,97,00/-. the petitioner is unable to comply the aforesaid condition. Therefore, the learned counsel for the petitioner prays to modify the condition.

3. Today, when the matter is taken up for hearing, the learned counsel for the petitioner submitted that due to poverty, the petitioner did not comply with the condition imposed by this Court and again he filed an application seeking to modify the condition imposed by this Court to deposit Rs.1,50,000/- at Mediation and Conciliation Centre Dharmapuri. Hence, the learned counsel prays to modify the condition.

4.On earlier occasion, the petitioner requested this Court to modify the condition imposed by this Court. Though it was modified, he did not comply with https://www.mhc.tn.gov.in/judis 1/2

vsn the condition. Again, the petitioner has filed an application to modify the condition imposed by this Court. Now, this modification petition has been filed on a different ground, which is not permissible. Hence, this petition for modification of the condition imposed by this Court dated in Crl.O.P.No.30966 of 2022 is not be acceded to and accordingly, this miscellaneous petition is dismissed. However, time is extended for a period of two weeks for complying with the conditions imposed by this Court on 15.12.2022.
