C.R.P.No.1634 of 2022 C.R.P.No.1634 of 2022 Dr.D.NAGARJUN, J.

This petition is filed to strike off D.V.C.No.7 of 2022 pending on the file of the learned Judicial Magistrate, Arani.

2. It is submitted by the learned counsel for the petitioners that the wedding of the 1st petitioner has taken place with the respondent in the year 2017 and subsequent to the marriage, both of them lived only for limited time in the house belonging to the petitioners 1 to 3 at Kalavai, Ranipet District. Subsequently, both the 1st petitioner and respondent started residing at Chennai. Dispute arose between them and from 2018 onwards they are living separately. The 1st petitioner filed application seeking divorce in HMOP.No.34 of 2020 on the file of the Sub-Court, Ranipet. Subsequently the respondent has filed Domestic Violence Case in DVC.No.7 of 2022 against all the petitioners.

3. It is submitted that the petitioners 2 and 3 are parents of the 1st petitioner, 5th petitioner is the sister of the 1st petitioner and the 4th petitioner is the husband of the 5th petitioner, are residing elsewhere. It is Page No.1/2 https://www.mhc.tn.gov.in/judis

C.R.P.No.1634 of 2022 also submitted that there was no occasion for the petitioners 2 to 5 to live under one roof with respondent and no occasion arose to commit domestic violence and thus allegations levelled against them are false.

4. Admit. Issue notice to the respondent returnable by 19.07.2023. Private notice is also permitted.
