TEEKAA RAMAN CRIMINAL MISCELLANEOUS PETITION No.10125 of 2018 IN CRL RC.894/2018 ELANGO, [ PETITIONER ] Vs SANTHA, [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal APPEAL No.894 OF 2018 on the file of the High Court, the High Court will be pleased to Suspend the sentence imposed on the petitioner by the learned District Munsif cum Judicial Magistrate of Denkanikottai dated 05.10.2017 in C.C.No.58 of 2014 and confirmed by the learned Principal Sessions Judge of Krishnagiri on 14.06.2018 in Crl.Ap.No.46 of 2017 and enlarge the petitioner on bail pending disposal of the above Crl.R.C.NO.894/2018.

Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.RC.No.894 of 2018 on the file of the High Court and upon hearing the arguments of MR.V.NICHOLAS, Advocate for the petitioner the court made the following order:- This petitioner was convicted by the trial Court for the offence under Section 138 of Negotiable Instrument Act 2012 and sentenced to undergo one year R.I and imposed with compensation of Rs.2,000/- IDSI for 1 month in addition to the sentence passed. Challenging the said conviction and sentence, pending revision, the petitioner has filed the present petition.

2. The sentence of the imprisonment imposed on the petitioner shall stand suspend on condition that the petitioner shall deposit for a sum of Rs.2,00,000/- awarded by the Court below as compensation within a period of one week from today and on such deposit, the petitioner shall release on bail on his executing a bond for a sum of Rs.10,000/- with two sureties each for a likesum to the satisfaction of the trial Court and on a further condition that the petitioner https://hcservices.ecourts.gov.in/hcservices/
