ORDER
The present writ petition has been filed seeking a mandamus to the first respondent forbearing him from opening the tender documents with respect to the tender notice No15/2025-206/HDO/NH dated 17.12.2025.
2. The petitioner is a Class I Contractor registered with the Highways Department. The first respondent has floated a tender vide Tender Notice No.15/2025-2026/HDO/NH dated 17.12.2025 for its project viz., Widening from Intermediate Lane to Two Lane and Strengthening at km 60 - 11/350 and 11/700 - 15/2 of Vilangadu Road (M-743). The last date for online submission of the tender was on 19.01.2016 upto 1500 hrs., and the opening of the tender was on 20.01.2026 at 1500 hrs. Clause 11 of the tender would stipulate that the tenderer/bidder has to submit the 'Work Inspection Certificate' issued by the Divisional National Engineer, Highways Department, the second respondent herein, along with its tender documents, failing which, the tender would be summarily rejected. Clause 12 also stipulates the last date for submitting the application before the second respondent for issuance of Work Inspection __________Page 2 of 5
Certificate, was on 06.01.2026 upto 17.45 hrs. The petitioner would submit that immediately after downloading the tender documents, he approached the second respondent with his application for issuance of Work Inspection Certificate, but the officials refused to receive his application. Hence, the petitioner has submitted his representation to the second respondent on 05.01.2026. But, till date, the second respondent has not conducted the inspection of his plant and machineries, and issued the Work Inspection Certificate. Hence, the petitioner is before this Court.

Mr.V.Jeevagiridharan, learned Additional Government Pleader appearing for the respondents 1 and 2, has produced before the Court the communication of the second respondent dated 06.01.2026, addressed to the petitioner, wherein the Divisional Engineer (NH) has informed the petitioner that the officials would visit the site of the petitioner on 09.01.2026.
