Application No.417 of 2022 is filed to reject the plaint against item 4 of 'A' Schedule suit property.

2. When the matter is taken up, the learned counsel for the applicant submitted that the first defendant namely B.Musthafa was dead and therefore, he prays that he may be granted permission to withdraw this application with liberty to file fresh application for impleading the legal representatives of the deceased first defendant.

3. Considering the submission, this Court is inclined to grant permission to withdraw the application with liberty.

4. Therefore, this application is dismissed as withdrawn with liberty to file fresh application for impleading the legal representatives of the deceased first defendant.
