ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.12.2025, for the alleged offence punishable under Sections 332(b), 309(b) and 311 of BNS, 2023 in Crime No.61 of 2025 on the file of the respondent police seeks bail.

2. The allegation against the petitioner is that he entered the house of the defacto complainant in the early hours of the morning, attacked him with knife and robbed 23 sovereigns of gold and ran away from the scene of occurrence. Hence, a complaint was lodged and the petitioner was arrested.

3. Learned counsel appearing for the petitioner submitted that the petitioner is a first time offender and that he has no previous case pending against him. Hence, he prays to grant bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are totally four accused in this case and the petitioner is ranked as A2. He further submitted that A4 is still absconding and that the investigation is still pending. He further submitted that only a portion of the stolen property has been recovered. However, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. On perusal of the FIR and other connected materials, it is revealed that the petitioner entered the house of the defacto complainant while he was sleeping, attacked him with a knife and caused severe injuries and thereafter decamped with 23 sovereigns of gold from the house. Though it is stated that the 2/4

petitioner has no previous case, considering the gravity of the offence and the stage of investigation, this Court is not inclined to grant bail to the petitioner.
