M.Nirmala ... Respondent Civil Revision Petition filed under Article 227 of the Constitution of India seeking to dispose of I.A.No.267 of 2016 in O.S.No.169 of 2013 on the file of the Subordinate Court, Tambaram within a stipulated time. For Petitioner : Mr.C.Shankar
O R D E R
Pursuant to the preliminary decree passed in O.S.No.169 of 2013, the plaintiff filed the final decree application in I.A.No.267 of 2016 on the file of the Subordinate Court, Tambaram. The plaintiff has filed the above Civil Revision Petition to direct the trial Court to dispose of the final decree application in I.A.No.267 of 2016 within a time frame.
2.The learned counsel appearing for the petitioner submitted that though the petition has been filed by the plaintiff in the year 2016, the matter has been periodically adjourned for filing vakalat and counter. Further, the learned counsel submitted that in view of the long pendency of the matter, the petitioner/plaintiff is put to hardship and prejudice. 3.Having regard to the submissions made by the learned counsel for the petitioner, taking into consideration the limited prayer sought for in the Civil Revision Petition, without expressing any opinion with regard to the merits of the case, I direct the Subordinate Judge, Tambaram, to dispose of the final decree application in I.A.No.267 of 2016 in O.S.No.169 of 2013, on merits and in accordance with law, within a period of six months from the date of receipt of a copy of this order.
4.With these observations, the Civil Revision Petition is disposed of. No costs.
