ORDER
(Order of the Court was made by C.Saravanan J.) The respondents in O.P.No.28 of 2021 have been duly served with notice. However, they have not appeared, despite service of notice.
2. The appellants are the legal heirs of the deceased petitioner in OP.No.28 of 2021. OP.No.28 of 2021 was dismissed vide order dated 27.09.2023. Though they were impleaded as the legal heirs of the deceased petitioner in OP.No.28 of 2021, no one appeared on their behalf in O.P.No.28 of 2021, leading to the dismissal of the prayer for Letters of Administration.
3. The appellants have now filed a miscellaneous petition in the present Original Side Appeal, seeking to adduce additional evidence. Having considered the averments in the affidavit and grounds filed in support of this petition, we find that the application has merit and deserves to be allowed.
