11422/19] Writ Petitions and writ miscellaneous petition filed under Article 226 of the Constitution of India praying that in these circumstances stated therein and in the respective affidavits filed therewith the High Court will be pleased to (i)pass an writ of certiorari or any other writ, direction or order, to call for the records pertaining to the order passed by the 1st respondent in AP.No.51 of 2010 dated 17.05.2013 and to quash the same(in WP.No.11618/2015)and (ii)Pass orders to permit the petitioner to withdraw Rs.2,00,000/- (Rupees Two Lakhs only) lying with the Special Deputy Commissioner of Labour, Chennai-6 (in WMP.No.11422/2019) pending disposal of the above WP.No.11618/2015 respectively.
Order : These petitions coming on this day for hearing upon perusing the petitions and the respective affidavits filed in support thereof and upon hearing the arguments of M/S.D.VENKATACHALAM, Advocate for the PETITIONER IN WP.11618/15 & 1st RESPONDENT IN WMP.11422/19 and of M/S.V.BALAMURUGAN, Advocate for the 2nd RESPONDENT IN WP.11618/15 & PETITIONER IN WMP.
It is represented by Mr.R.Anusam, General Manager, TNSTC (Kumbakonam) Ltd., Tiruchi Region that based on the Order dated 26.08.2019 passed by this Court, more particularly, paragraph no.7 of the said Order, the matter will be placed before the Board for arriving at an amicable settlement and that Board will consider the feasibility of extending the terminal benefits. He would further submit that normally the Board meeting will be conducted once in three months. However, he has assured that henceforth as and when a matter is referred to Lok Adalat by the Court, Board meeting will be conducted before the date of conduct of such Lok Adalat in future so as to inform the outcome of the decision taken in the Board meeting before the Lok Adalat.
He further requested to place this matter before the next Mega Lok Adalat scheduled to be held in the month of December 2019 in order to appraise the Board to take a firm decision/arrive at a settlement in this matter. 2.In view of the above submission, the members of this Lok Adalat are of the fond hope that the Board meeting will be conducted before the end of November 2019 and the decision taken thereon will be duly reported before the next Mega Lok Adalat. 3.Registry is directed to list this matter before the next Mega Lok Adalat in the month of December 2019. -sd/- 14/09/2019 / TRUE COPY / Sub-Assistant Registrar ( Statistics / C.S. ) High Court, Madras - 600 104.
