Prayer in all WPs.: Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of Certiorari calling for the records of the 2nd respondent Labour Court pertaining to the impugned Award, dated 05.08.2010 passed in I.D.Nos.131, 128 and 129 of 2009 respectively and quash the same in so far as it relates to a compensation of Rs.40,000/- directed to be paid to the 1st respondent workman. For Petitioners : Mr. J. Ramesh, AGP for all Wps. For Respondents : Mr. Varadarujulu, for all WPs.
C O M M O N O R D E R The Deputy Director of Horticulture, Horticulture, Navlock Farm, Thorapadi, Vellore District sent a letter to the office of the learned Additional Government Pleader on 18.11.2019 stating as follows:
" As against the above said Hon'ble Court, Vellore's award dated 5.08.2010 made in ID No.128 and 131 of 2009, above said writ petitioners namely Mr.N. Subramani S/o Narayanasamy, Mrs. S. Poongavanam W/o Sampath, Mrs.
V.
Krishnaveni W/o Veeraraghavan were moved before the Hon'ble High Court at Chennai.
As the petitioners failed to produce their age certificates or any evidence for their age before the labour court, consequently, they were not allowed to re instate in service but granted a compensation of Rs.40,000/- (Rupees Forty Thousand Only) to each petitioner in their final award Dt. 5.08.2010.
That based on the above said labour courts award Dt. 05.08.2019 there is a sum of Rs.40,000/- each petitioner has been duly paid to the concerned daily wage workers (Tmt.Poongavanam, Tmt.Krishnaveni Thiru.N.Subramani) as per the stamped receipts Dt:10.10.2012 through cheque payment bearing Nos.221773, 221774 and 221775 Dt: 09.10.2012 and that therefore the above said writ petition may kindly be withdrawn as requested herewith.
Please do the needful forthwith."
2. In view of the fact that the issues between the parties had already been settled. The Deputy Director of Horticulture made a request to withdraw the Writ Petitions and accordingly the Writ Petitions stand disposed of as withdrawn. No costs.
