This petition is filed seeking to condone the delay of 2330 days in re-presenting the above Tax Appeal.

2.Since the petitioners have preferred to withdraw the above appeal, we are of the view that no prejudice would be caused to the respondent in allowing the present CMP.

3. Hence, without issuing notice to the respondent, this Civil Miscellaneous Petition is allowed and the delay is condoned.

4. Registry is directed to number the Tax Appeal, if it is otherwise in order.
