PRAYER : Petition under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents to issue a "No Objection Certificate" to run the business of Massage Parlour, SPA, Beauty Parlour including the service of cross massage, in the name and style of "Dream Blossom Saloon and Spa" at 383, Sanganoor Road, 1st Floor, PartI, Ganapathy, Coimbatore - 641 006, by passing order on the petitioner's representation dated 25.11.2023.

ORDER

This writ petition has been filed seeking for a direction to the first respondent to grant No Objection Certificate to the petitioner to enable the petitioner to run the SPA based on the representation dated 25.11.2023.

2. Heard Mr.Balaji Thirumoorthy, learned counsel for petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor appearing for respondents.

3.The learned Additional Public Prosecutor submitted that on 30.11.2023, the respondent had sought for the production of certain documents from the petitioner. Since the petitioner did not produce those documents, there was no further progress on the application made by the petitioner.

4.In response to this submission, the learned counsel for the petitioner submitted that the petitioner submitted all the relevant documents as sought for by the respondent through letter dated 30.11.2023. This stand taken by the petitioner is taken note of.

5.Taking into consideration the facts and circumstances of the case and without going into the merits of the case, there shall be a direction to the first respondent to deal with the representation made by the petitioner dated 25.11.2023 on its own merits and in accordance with law and in line with the relevant Government Order/circulars and a decision shall be taken within a period of two (2) weeks from the date of receipt of a copy of this order.
