The petitioner, who was arrested and remanded to judicial custody on 18.12.2022 for the alleged offence under Sections 419 and 420 of IPC in Crime No.909 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner along with other accused waylaid the defacto complainant and introduced themselves as they are police officials and taken an amount of Rs.29,00,000/- from him and thereafter, cheated him. Hence the complaint.
3. The learned counsel appearing for petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 18.12.2022 and he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioner along with other accused cheated the defacto complainant by impersonating themselves as they are the Police officials and taken an amount of Rs.29,00,000/- from him. He further submitted that a sum of Rs.24,30,000/- has been recovered from the arrested accused and the investigation is at the preliminary stage. However, he opposed for grant of bail to the petitioner.

Considering the facts and circumstances of the case and the gravity of the offence committed by the petitioner and the investigation is at the preliminary stage, this Court is not inclined to grant bail to the petitioner.
