PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the Fourth Respondent to file the report relating to the genuineness of documents of the 50 lakhs worth of Immovable property security deposit given by the Chokalingam on behalf of A-1 S.Subramani in Crime No. 247 of 2009 and in C.C. No. 345 of 2012 pending before the XIth Metropolitan Magistrate, Saidapet Chennai - 600 015 and to direct the Fourt respondent to take action according to the law against A-1 S. Subramani.

O R D E R

Today when the matter has come up for hearing learned counsel for the petitioner would submit that the trial was over, and the accused has been convicted and the appeal filed by him was also dismissed and nothing remains to adjudicate in this petition.

2. Hence, both the Criminal Original Petitions are dismissed as infructuous.

3. It is stated that, now the learned XI Metropolitan Magistrate, has filed a complaint against the respondent/accused for filing forged documents and a final report was also filed. The matter is pending for trial for more than four years in C.C.No.10044 of 2017 on the file of the Special C.C. Court, Egmore.

4. Learned counsel for the respondent submits that trial has already commenced on 19.11.2021 and four witnesses have been examined. In the above, circumstances, the learned Magistrate is directed to complete the trial in C.C.No.10044 of 2017, pending on the file of the Special C.C. Court, Egmore, Chennai as expeditiously as possible.
