IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 12.01.2026
CORAM
THE HONOURABLE MR JUSTICE K.RAJASEKAR Crl.O.P.No.819 of 2026 V.Raambalaji ... Petitioner Vs.
State rep by the The Inspector of Police, Annur Police Station, Annur, Coimbatore District.
... Respondent PRAYER : Criminal Original Petition filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, to enlarge the petitioner on bail in the event of arrest due to the pending investigation in Crime No.602 of 2025 on the file of the respondent police.
For Petitioner : Ms.Jessy Monica For Respondent : Ms.J.R.Archana Government Advocate (Crl. Side)
ORDER
The petitioners, who apprehend arrest for the alleged offence under Sections 296(b), 115(2) 118(1) and 351(2) of BNS r/w Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 in Crime No.602 of 2025, on the file of the respondent police seek anticipatory bail. 1/4
2. Earlier, this Court dismissed the petitioner's bail petition on 12.12.2025 in Crl.O.P.No.33984 of 2025 on the following reasons: " 5. Considering the facts and averments made in the FIR, I am of the view that the 1st petitioner caused severe injuries to the defacto complainant, who had just delivered a baby and was also abused her with dire consequences, resulting in the issuance of a legal notice between the parties. Hence, this Criminal Original is dismissed in so far as 1st petitioner is concerned. ...... ".
3. Now, the present petition has been filed without any change in circumstances after the dismissal of the petitioner's earlier bail petition. This clearly shows that the petitioner has abused the process of law. Hence, I am not inclined to reconsider the earlier order.
4. Accordingly, this Criminal Original Petition is dismissed. 12.01.2026 Vv 2/4
