Respondents PRAYER: Petition under Article 226 of the Constitution of India for issuance of a writ of mandamus directing respondents 1 to 4 to remove the encroachments in the Odai/water body bearing S.No.24, Tharapakkam Village, Pallavaram Taluk, Kanchipuram District and restore the same to its original position in compliance with the Circular No.T1/23155/2005, dated 19.07.2005, issued by the 1st respondent by considering the petitioner's representation dated 09.01.2016.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The writ petition has been filed with a prayer to remove the encroachments in the Odai/water body.

2. Respondents 1 to 4 before us are official respondents and Mr.M.K.Subramanian, Government Pleader accepts notice on their behalf.

3. It is alleged by the writ petitioner that the fifth respondent has encroached upon the water body.

4. We direct the third respondent/Tahsildar to cause a local inspection of the land comprised in Survey No.24, Tharapakkam Village, Pallavaram Taluk, Kanchipuram District, within a fortnight and if any encroachment is found, the official respondents shall take action in accordance with law after putting on notice all concerned, particularly the fifth respondent before us, and conclude the proceedings within two months.
