These Petitions have been filed i) to condone the delay of 1658 days in filing the petition to bring on record the legal heirs of the deceased third respondent Vasuki, ii) to set aside the abatement and iii) to bring on record.
2. Heard the learned counsel for the petitioners and the learned counsel for the first respondent, and perused the materials available in the record.
3. On being satisfied with the averments stated in the affidavit filed in support of the petitions and the submissions made by the learned counsel for the petitioners, these petitions are allowed.
4. The Registry is directed to carry out necessary amendment and list the Second Appeal on 26.02.2026, if it is otherwise in order.
5. Issue notice to the newly added respondents in the second appeal. Private Notice is also permitted.
