ORDER

This writ petition has been filed to direct the first respondent to transfer patta bearing No.221 comprised in S.Nos.558/6, 558/7 and 573 in the name of the petitioner without insisting upon the Aadhar Card of the petitioner and to permit the petitioner to file an application seeking for transfer of patta physically instead of filing it through online.

2. The petitioner claims to be a foreign citizen of Indian origin and he is in possession of OCI card. According to the petitioner, if the application is submitted through online, there is a requirement for submitting the application along with the Aadhar card. Since the petitioner is a foreign citizen of Indian origin and is possessing an OCI card, which is equivalent to an Aadhar card, the petitioner claims that he has to be allowed to apply for patta physically instead of through online since the petitioner will not be in a position to apply for patta through online as the online mode does not permit the same, without possessing an Aadhar card.

3. The petitioner had submitted an online application. Since the petitioner does not possess an Aadhar card, and the OCI card is equivalent to an Aadhar card, the petitioner cannot be deprived of submitting the application, seeking for transfer of patta in his name. In similar circumstances, this Court had permitted the parties, who are in possession of OCI cards to submit applications, seeking

for issuance of patta without the production of Aadhar card. Since the petitioner is also similarly placed, this Court is inclined to permit the petitioner to submit the application, seeking for transfer of patta in his name for the patta bearing No.221 comprised in S. Nos.558/6, 558/7 and 573, which is morefully described in the affidavit filed in support of this writ petition, physically instead of through online practise.

4. Mr. S.Arumugam, learned Government Advocate accepts notice on behalf of the respondents.

No prejudice would also be caused to the respondents if the petitioner is allowed to submit the application physically for the reasons stated supra and a direction is issued to the respondents to consider the same on merits and in accordance with law after giving due consideration to the supporting documents and after hearing the objections of any of the neighbouring land owners and any other third party whom the first respondent deems it fit to enquire within a time frame to be fixed by this Court.

6. This Court is not expressing any opinion on the merits of the petitioner's application dated 25.11.2025, seeking for transfer of patta in his name.

For the foregoing reasons, this Court directs the petitioner to submit the application, seeking for transfer of patta No.221 comprised in S.Nos. 558/6, 558/7 and 573 morefully described in the affidavit filed in support of this writ petition in his name by filing the same physically instead of through online and the first respondent is directed to receive the said application physically without insisting on the production of the Aadhar card but insisting for the production of a copy of the OCI card of the petitioner within a period of two weeks from the date of receipt of a copy of this order.

On receipt of the said application from the petitioner, physically within the stipulated time, this Court directs the first respondent to pass final orders on merits and in accordance with law on the petitioner's application seeking for transfer of patta bearing No.221 comprised in S.Nos.558/6, 558/7 and 573, morefully described in the affidavit filed in support of this writ petition, in his name within a period of four weeks thereafter, after hearing the objections of the neighbouring land owners if any and any other third party whom the first respondent deems it fit to enquire.

8. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
