JUDGMENT
(Made by the Hon'ble Chief Justice) Heard learned counsel for the parties.
2. In view of the submission made by learned counsel for the appellant that the impugned order passed by the learned Single Judge is without issuing any notice and recording a finding of possession without any opportunity of hearing, it is set aside. The writ petition is restored to its original number.
3. The appeal is allowed accordingly. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
