O R D E R

This writ petition has been filed challenging the proceedings issued by the respondents vide Na.Ka.No.186/47527/A-1(2)/2010 dated 02.08.2010, whereby the request made by the petitioner for being conferred with upgradation as 'Special Sub-Inspector' from the post of 'Head Constable' was rejected. The reason assigned in the impugned order is that the petitioner has not completed 10 years of service in the post of 'Head Constable' and therefore, he is not entitled for upgradation to the post of 'Special SubInspector'.

2. The learned counsel for the petitioner submitted that during the pendancy of the present writ petition, the petitioner has already retired from service and he intends to submit a representation before the respondents seeking upgradation to the post of 'Special Sub-Inspector', which is also called as 'Out of Seniority Sub-Inspector'.

3. In the light of the above request made by the learned counsel for the petitioner, and without going into the merits of the writ petition, this writ petition is disposed of, permitting the petitioner to submit a representation

before the respondents seeking the relief as above and in case, if any such representation is submitted by the petitioner, the respondents shall consider the same and pass appropriate orders thereon, as expeditiously as possibly at any rate within a period of eight weeks from the date of receipt of a copy of this order. No costs. Connected miscellaneous petitions, if any, shall stand closed.
