No.201, Ozhalakoyil Village, Nambiyur Taluk, Erode District.

ORDER

This writ petition has been filed, challenging the rejection order dated 08.12.2025 passed by the third respondent, rejecting the petitioner's request for

issuance of patta for the property morefully described in the prayer to this writ petition within a time frame to be fixed by this Court.

2. The petitioner has challenged the impugned rejection order on the ground that the impugned order is a non speaking order.

3. Mr. C. Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents.

4. As seen from the impugned order dated 08.12.2025, no reasons whatsoever have been stated by the third respondent for rejecting the petitioner's application seeking for issuance of patta. Since the impugned order dated 08.12.2025 is a non speaking order, necessarily it has to be quashed and the matter remanded back to the respondents for fresh consideration on merits and in accordance with law by passing a speaking order.

5. This Court is not expressing any opinion on the merits of the petitioner's representation, seeking for issuance of patta.

6. For the foregoing reasons, the impugned order dated 08.12.2025 passed by the third respondent is hereby quashed and the matter is remanded back to the third respondent for fresh consideration on merits and in accordance with

law on the petitioner's application, seeking for issuance of patta in favour of the petitioner for the property morefully described in the prayer to this writ petition within a period of twelve weeks from the date of receipt of a copy of this order after giving due consideration to the documents produced by the petitioner along with the petitioner's application seeking for issuance of patta. The third respondent shall also hear the objections of the rival claimants if any before passing the final order.

7. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
