JUDGMENT

The learned counsel for the appellant, on instructions, seeks permission of this Court to withdraw this Second Appeal as the matter has been settled out of Court and also made an endorsement in the Appeal to that effect and further prays for refund of the Court Fee.

In the light of the endorsement made by the learned counsel appearing for the appellant, this Second Appeal is dismissed as withdrawn and the refund of Court Fee, if any, is subject to entitlement. No costs. Consequently, the connected miscellaneous petition is also dismissed.
