This Civil Miscellaneous Petition has been filed to condone the delay of 218 days in filing the above appeal.

2. Heard the learned counsel for the petitioner.

3. Ms.N.B.Surekha, learned counsel takes notice for the 2nd respondent and she has got objections in allowing the petition.

4. The petitioner would submit that due to insufficient funds for filing this petition, delay of 218 days occurred.

5. Accepting the averments made by the petitioners in the affidavit enclosed with the petition, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 218 days shall stand waived.
