ORDER
This Writ Petition has been filed for direction to the Respondents to provide the petitioner a suitable permanent alternative employment such as 'Non ITI -Helper' in accordance with Section 20 (4) of Rights of Persons with Disabilities Act, 2016 till the Petitioner attains the age of superannuation commensurate with his health condition and to treat the entire period from 21.05.2018 till date during which the petitioner was not given alternative employment / light during, as duty period for all purpose and on that basis and pay the differential salary and allowances for the said period. 2.
The learned counsel appearing for the petitioner would submit that the petitioner joined in the first respondent Corporation as Driver in the year 2007. In the year 2018, the petitioner suffered with severe chest pain and he was
admitted in the hospital and the doctor advised the petitioner to do light work. After discharge, again the petitioner undergone cardiac procedure and on the basis of the medical ground, the petitioner was given timekeeper duty in the year 2019. Subsequently, the petitioner appeared before the Medical Board of Rajiv Gandhi Government Hospital in the year 2020. The Medical Board opined by declaring the petitioner as unfit to the post of Driver thereby the petitioner was given alternative employment as Timekeeper. However, recently the petitioner has been directed to assume charge as Driver. Hence, the present writ petition has been filed.

This Court directed the respondents to get instructions whether the petitioner is deserving light duty and pursuant to which the respondents passed order dated 14.01.2026 to do light duty for a period of six months. In the meanwhile, the petitioner was directed to appear before the Medical Board for fresh certificate for light duty.

In view of the letter dated 14.01.2026, this writ petition is liable to be disposed of. After expiry of the said six months, the respondents are directed to send the petitioner before the Medical Board and as per the Medical Board opinion, the respondents are directed to give light duty if the Medical Board
advises and to pay other benefits from the year 2018 to the petitioner, if otherwise eligible. Accordingly, this writ petition is disposed of. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
