This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking withdrawal of H.M.O.P. No.269 of 2025 from the file of the Family Court, Tanjore and transfer of the same to the file of the Family Court, Chennai.

The marriage between the petitioner and the respondent was solemnized on 06.06.2019 at Sri Subramaniyar Alayam, Mudukulathur, Ramanathapuram as per Hindu rites and customs. Out of their wedlock, a male child was born to them. The respondent husband filed divorce petition in HMOP No.269 of 2025 before the Family Court, Tanjore on the ground of cruelty. 4.

The petitioner/wife is stated to be residing at Chennai along with the child and cannot undertake repeated travel with the child and has to travel about 700 Km for every posting, which is causing undue hardship. The petitioner is not in a position to travel alone and the travel itself is onerous and unsafe.

In the facts and circumstances, this Court is satisfied that the request for transfer deserves acceptance, so as to avoid hardship to the petitioner and to ensure effective adjudication. 6.

Accordingly, TR.C.M.P. No.46 of 2026 is allowed and H.M.O.P. No.269 of 2025 pending on the file of the Family Court, Tanjore is withdrawn and transferred to the file of the Family Court, Chennai. The Family Court, Tanjore shall transmit the entire records to the Family Court, Chennai within four weeks from the date of receipt of a

copy of this order. The transferee Court shall dispose of the matter in accordance with law as expeditiously as possible uninfluenced by any observations made in this order and Consequently, C.M.P. No.1113 of 2026 is closed. No costs.
