Prayer: Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to grant pension to the petitioner from the date of his eligibility along with eligible arrears after adjusting the deducted CPS amount till his retirement by counting his 50 percentage of the past service along with his regular service as the qualifying service for the purpose of pension and by considering his written representation dated 10.11.2025 submitted in terms of G.O.(D)613 Municipal Administration and Water supply department dated 24.10.2025. ORDER
The present Writ Petition has been filed seeking a direction to the respondents to grant pension to the petitioner from the date of his eligibility along with eligible arrears after adjusting the deducted CPS amount till his retirement by counting his 50 percentage of the past service along with his regular service as the qualifying service for the purpose of pension and by considering his written representation dated 10.11.2025 submitted in terms of G.O.(D)613 Municipal Administration and Water supply department dated 24.10.2025.
2. Mr.C.Selvaraj, learned Additional Government Pleader takes notice on behalf of the respondents.
3. The petitioner was initially was absorbed as daily basis on 15.04.1991 in Karur Municipality and joined in service on 24.04.1991. Subsequently, his services were regularized on 12.06.2006 and upon attaining superannuation, he retired from service as Wireman Helper on 31.01.2025. The grievance of the petitioner is that, despite the petitioner having rendered 34 years of continuous service and 19 years of regular service, he was not brought under Old Pension Scheme as his services were regularized only after the introduction of CPS scheme. Therefore, the petitioner submitted a representation dated 10.11.2025 to the respondents seeking to grant him benefit under Old Pension Scheme. However, the said representation has not been considered till date. Hence, the present Writ Petition.
4. Learned counsel appearing for the petitioner submitted that, it would suffice, if this Court, issues a direction to the respondents to consider the petitioner's representation dated 10.11.2025 and pass appropriate orders on the same on merits within the time that may be stipulated by this Court.
5. On the above contention, this Court, heard the learned Additional Government Pleader appearing for the respondents.

In view of the limited relief sought for in this Writ Petition, this Court without expressing any opinion on the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 10.11.2025 and pass appropriate orders on the same in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.
7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
