3.Though the 2nd respondent entered appearance through counsel, there is no representation for him today.

4.Heard the learned counsel appearing for the petitioner.

5.Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 39 days is condoned and the petition is ordered.
