JUDGMENT

This Civil Miscellaneous Second Appeal is filed against the Judgment and Decree dated 14.08.2007 made in C.M.A.No.24 of 2006 on the file of the I Additional District Court, Erode.

2. Today, when the matter is taken up for hearing, the learned Counsel for the appellant seeks permission of this Court to withdraw the appeal and he has also made an endorsement to that effect.

3. In view of the endorsement made by the learned counsel for the appellant, this Civil Miscellaneous Second appeal is dismissed as withdrawn. No costs.
