TERMS OF SETTLEMENT Both parties have agreed to settle the matter as per the terms of settlement, dated 05.11.2014.
2. The learned counsel appearing for the first respondent / plaintiff would contend that three installments were paid by the appellants and to that effect he made an endorsement also in the terms of settlement, dated 05.11.2014. Thus the defendants / appellants though preferred an appeal accepted the decree and paid the amount, as per the terms of settlement, dated 05.11.2014 thereby satisfying entire decree and Full Satisfaction is also recorded even by the plaintiff /decree holder.
3. Today, both the parties are absent and already in terms of settlement, the parties have signed and therefore, no fresh memo or signatures are required, that too, in view of the fact the counsel for the first respondent / decree holder has agreed that he has received the amount and made an endorsement in the terms of settlement, dated 05.11.2014, the appeal suit is dismissed as settled. The aforesaid terms of settlement dated 05.11.2014 shall form part of the award.
4. The full Court fee paid shall be refunded to the appellants in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
