The writ petition has been filed seeking issuance of a writ of certiorarified mandamus calling for the records of the respondent pertaining to sale notice issued under Rule 8(6) of the Security Interest (Enforcement) Rules, 2002 dated 26.11.2024 and quash the same as illegal, devoid of merits and against principles of natural justice and consequently direct the respondent not to conclude the e-auction sale which is scheduled on 09.01.2025.

3. The challenge in the writ petition is to the sale notice. It is brought to the notice of this court by learned counsel for the respondent that the sale is concluded and the writ petition has become infructuous.

4. Therefore, nothing survives for further adjudication in the matter. Accordingly, the writ petition is dismissed. There shall be no order as to costs.
