2. Today, when the matter is taken up for hearing, the learned Counsel for the appellant seeks permission of this Court to withdraw the Civil miscellaneous second appeal and he has also made an endorsement to that effect.

3. In view of the endorsement made by the learned counsel for the appellant, this Civil Miscellaneous Second appeal is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is closed.
