ORDER

Relying on partition deed bearing document no.2905/2009, the petitioner executed settlement deed dated 19.12.2025 in favour of his daughter and presented the same for registration. On the ground that the request for registration was orally declined, the present writ petition has been filed.

Learned counsel for the petitioner submits that the reference to document no.2941/1985 dated 31.10.1985 in the partition deed contains an inadvertent typographical error and that the correct reference should be document no.2941/1955, dated 31.10.1955. He also submits that the alleged disparity between the schedule of the partition deed and the schedule of the settlement deed is on account of a sub-division of S.No.173/1 into S.Nos.173/1 & 173/2.

3. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for the sole respondent. He submits that the petitioner may be directed to submit all relevant documents and provide an explanation with regard to the two discrepancies adverted to by learned counsel for the petitioner. Upon receipt of such explanation, he submits that the registering officer would either register the document or issue a speaking order of refusal.

4. Considering the above submissions, the writ petition stands disposed of on the following terms:

(i) The petitioner shall re-present the settlement deed before the registering officer within two weeks from the date of receipt of a copy of this order. Such re-presentation should be accompanied by the original or certified copy of document no.2941/1955. The petitioner shall also provide an explanation with regard to the discrepancies in the schedule as between document no.2905/2009 and the settlement deed. (ii) Within two weeks from the date of receipt of the above mentioned documents, the registering officer shall register the instrument subject to fulfilment of other requirements relating to registration or issue a speaking order of refusal.

There will be no order as to costs.
