Respondent(s) PRAYER Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of a Writ of Mandamus, directing the respondents to pay interest of 10 percent to the petitioners for belated payment of Gratuity, Leave Salary, Provident fund and commutation of pension amounts within a time frame to be fixed by this Court.

ORDER

The Writ Petition has been filed to direct the respondents to pay 10% interest for the belated payment of terminal benefits such as Gratuity, Leave Salary, PF and Commutation of pension amount to the petitioners.

2. Mr.A.Vinothraj, learned counsel takes notice on behalf of the first respondent. Mr.C.S.K.Sathish, learned counsel takes notice on behalf of the second respondent. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

3. It is the case of the petitioners that the petitioners, who had joined the services of the respondent Corporation, had already retired from service, however, the terminal benefits have been settled belatedly. Therefore, the petitioners claimed 10% interest on the belated payment of terminal benefits and they have also made representations to pay interest for the belated payment of terminal benefits which has not been evoked any response so far. Hence, the petitioners are before this Court.

4. Heard the learned counsels appearing on either side and perused the materials available on record.

5. In view of the limited request made by the petitioners with regard to interest on the belated payment of terminal benefits, this Court directs the respondents to pay interest @ 6% for the belated payment of terminal benefits from the date of retirement till the date of actual disbursal of terminal benefits of the petitioners, within a period of six (6) weeks from the date of receipt of a copy of this order taking into account the bank rate of interest on deposits.

6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
