These two applications are presented by a person claiming title to 7.45 Acres in Survey No.97/2A at Ezhuvaraimukki Village, Sattankulam Taluk, Tuticorin District. The applicant traces title to sale deeds dated 31.12.1983, 04.02.1984 and 22.09.1994 under which the predecessors-ininterest of the applicant purchased the property. Thereafter, it is asserted that the property was conveyed to the applicant's father under a registered sale deed dated 16.05.1996, which was registered as Document No.407 of 1996. The applicant also relies upon Patta No.852 and Patta No.1140. Therefore, it is submitted that the applicant is the owner of an extent of 7.45 Acres in the Survey Number and location described above. Consequently, it is contended that the auction sale notice should be set aside insofar as it relates to the above extent.

2. After examining the documents produced by the applicant, learned counsel for the learned Administrator states that the claim made by the applicant may be accepted in view of the fact that the applicant has https://www.mhc.tn.gov.in/judis 1/2

Anu established that title devolved on him much prior to the commencement of winding up.

3. Upon considering the submissions, it is clear that Comp.A.No.16 of 2022 is liable to be allowed. Accordingly, the extent of 7.45 Acres in Survey No.97/2A at Ezhuvaraimukki Village, Sattankulam Taluk, Tuticorin District is deleted from the auction sale notice dated 03.12.2021. In view of Comp.A.No.16 of 2022 being allowed, Comp.A.No.15 of 2022 is closed.
