J U D G M E N T

The appellant has filed the Civil miscellaneous second appeal as against the Judgment and Decree dated 29.03.2007 passed in C.M.A.No.10 of 2006 on the file of the Prinicpal District Court, Vellore, confirming the Judgment and Decree dated 23.06.2006 passed in H.M.O.P.No.80 of 2004 on the file of the Sub-Court, Tirupathur.

2. The matter was already took adjournment by the learned Counsel for the appellant on 06.09.2018 and 27.09.2018 respectively 'for reporting settlement. Today, when the matter is taken up for final disposal, the learned counsel for the appellant seeks permission of this Court to withdraw this appeal and he has also made an endorsement to the effect. As per the instructions of our client. I may be permitted to withdraw the CMSA.No.22 of 2008.

3. Based on the submission and the endorsement made by the learned counsel for the appellant, this Civil Miscellaneous Second Appeal is dismissed as withdrawn. No costs. 04.10.2018
