ORDER

The petitioner, who was arrested and remanded to judicial custody on 06.12.2025 for the offences punishable under Sections 296(b), 351(2) of BNS and Section 4 of TN Public Property ( Prevention of Damage and Loss) Act, 1992 r/w Section 3 of the Explosive Substances Act, 1908 in Crime No.364 of 2025, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the first petitioner and the victim girl were studying in the same college. The first petitioner had taken photos of the victim girl when she was in the college, the same was questioned by the victim girl, for which the petitioner misbehaved with her. Due to which a complaint was lodged. Thereafter, the petitioner threatened the parents of the victim girl to withdraw the complaint. However, the parents of the victim girl refused to withdraw the complaint due to which the petitioner along with other accused set fire to the car belonging to the victim's family worth about 10 lakhs. Hence the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that investigation in this case is pending and one of the co-accused is still absconding.

Heard the learned counsels and perused the materials available on record.

6.Considering the facts of the case and the car that the petitioner along with other accused had set fire to the Maruti Car worth about Rs.10,00,000/- and investigation in this case is still pending, this Court is not inclined to grant bail to the petitioner.
