J U D G M E N T

The appellant has filed the Civil miscellaneous second appeal as against the Judgment and Decree dated 19.11.2007 in C.M.A.No.12 of 2007 on the file of the learned Additional District Judge (Fast Track Court No.2) Gobichettipalayam in reversing the fair and final order dated 15.02.2006 in H.M.O.P.No.66 of 2003 on the file of the learned Principal Subordinate Judge, Gobichettipalayam.

When the matter is listed today, the learned counsel for the appellant would submit that the appellant and the respondent are living together and the appellant is not interested to proceed the appeal. Hence, he seeks permission of this Court to dismiss this appeal as not pressed and he has also made an endorsement to the effect.
