ORDER

The petitioners/accused in Crime No.132 of 2024 for the offence under Sections 147, 294(b), 427, 448 and 506(ii) IPC, filed this quash petition.

2.The case of the prosecution is that on 20.04.2024 a meeting regarding 2024 General Assembly Election held at the residence of the second respondent at Mettukuppam, at that time, the petitioners entered the premises and abused them in filthy language and broke the chairs. Hence, the second respondent lodged a complaint to the respondent police and C.S.R.No.415 of 2024 assigned. Thereafter, FIR registered in Crime No.132 of 2024 for the offence under Sections 147, 294(b), 427, 448 and 506(ii) IPC.

3.The contention of the learned counsel for the petitioners is that both the petitioners and the defacto complainant belong to one political party. The defacto complainant convened a meeting for the previous General Assembly Election without consulting the petitioners on 20.04.2024 which was objected and questioned by the petitioners, at that time, there was heated arguments, exchange of words, push and pull which was projected as though Page No.2 of 6

the petitioners assaulted the defacto complainant. Now the defacto complainant realizing the same, come forward to withdraw the complaint. 4.The learned Additional Public Prosecutor submitted that on the complaint of the defacto complainant, a case in Crime No.132 of 2024 for the offence under Sections 147, 294(b), 427, 448 and 506(ii) IPC registered on 25.04.2024. The complaint is that A1 and A2 along with five musclemen entered the house of Jeganathan where the defacto complainant was discussing with regard to forthcoming General Assembly Election and assaulted the defacto complainant and also caused damages. He further submitted that investigation completed and charge sheet filed in C.C.No.174 of 2026 before the learned Judicial Magistrate No.II, Alandur. 5.

Today, the petitioners and the defacto complainant appeared before this Court, their identity confirmed by the respondent police. During interaction in my Chamber, the petitioners and the defacto complainant confirmed that the issue between them got resolved amicably. The defacto complainant submitted that he is not willing to proceed with the case and ready to withdraw the case.

6.The petitioners and the defacto complainant filed confirming affidavits individually and a joint compromise memo. From the affidavits, it is seen that the petitioners and the defacto complainant were having good relationship and the issue between them got resolved amicably. Further, the defacto complainant is not willing to proceed with the case and he is ready to withdraw the case. In view of the same, this Court finds that continuation of the proceedings will serve no purpose and it is only an abuse of process of law.

7.Accordingly, this Criminal Original Petition stands allowed and as a sequel, the case in Crime No.132 of 2024 on the file of the first respondent is quashed. Consequently, the charge sheet filed in in C.C.No.174 of 2026 on the file of the learned Judicial Magistrate No.II, Alandur is hereby quashed.
