This application is filed by the first defendant to condone the delay of 410 days in filing the written statement. In the affidavit in support, it is stated that the first defendant was travelling between Mumbai and Chennai and was unable to hand over the relevant documents to learned counsel for the first defendant for filing the written statement. It is further stated that the delay period included the period directed to be excluded by the Hon'ble Supreme Court due to the Covid - 19 pandemic. On instructions, learned counsel for the plaintiffs states that he has no objection to this application being allowed.

2. Upon examining the affidavit in support and being satisfied that sufficient cause is shown, the delay is condoned. Consequently, the Registry is directed to receive the written statement of the first defendant. The Registry is directed to place a note on service of suit summons on defendants 2 to 4. List the matter on 09.02.2023.
