ORDER

This Civil Revision Petition has been filed to direct the learned III Additional District Judge, Coimbatore to dispose of the suit in O.S.No.1108 of 2023 within a stipulated fixed by this Court.

2. The plaintiffs had filed the suit for partition and separate possession and for mandatory injunction to direct the 13th defendant to disconnect the electricity service connection issued in the name of the fifth defendant. The dispute is between the legal heirs of the brothers of the same family. At the time of filing of the suit the brothers were alive and now the legal heirs are contesting the suit. Originally the suit was filed in O.S.No.111 of 1997 and thereafter, the suit has been transferred to District Munsif Court, Palladam and renumbered as O.S.No.2252 of 2012 and now the suit pending before the III Additional District Judge, Coimbatore in O.S.No.1103 of 2023. The records further reveals that the defendants have not filed written statement in the suit and they were set exparte and thereafter, the exparte decree has been set aside.

3. Considering the conduct of the parties which shows that they are inclined to co-operate with the trial and since the suit is of the year 1997, the

trial Court is directed to dispose of the suit in O.S.No.1108 of 2023 within a period of three months from the date of receipt of a copy of this Order, without giving unnecessary adjournments to the parties.

4. Accordingly, this Civil Revision Petition is disposed of. No costs. 05-03-2026 Index: Yes/No Speaking/Non-speaking order vrc To The III Additional District Judge, Coimbatore.
