J U D G M E N T

When the matter was taken up for hearing on 13.12.2017, learned counsel for the appellant represented that the appellant had taken the papers from him. Hence, he was directed to file a memo to that effect. Recording the said statement, the Registry was directed to print the name of the appellant and to post the matter on 18.12.2017. Even today (18.12.2017), when the matter is called, though the name of the appellant is printed in the cause list, there is no representation for the appellant either in person or through counsel. There is also no representation for the respondent. Hence, the Second Appeal is dismissed for non prosecution. No costs.
