ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.12.2025, for the alleged offences punishable under Sections 191(2), 191(3), 296(b), 115(2), 118(1), 351(3), 109 of BNS, 2023 in Crime No.276 of 2025 on the file of the respondent police seeks bail. 1/4

2. The allegation against the petitioner is that he is arrayed as A1 in this case. It is alleged that due to previous enmity, the petitioner joined hands with other accused attacked the defacto complainant and two other persons, including his son, with wooden log indiscriminately, causing multiple injuries. It is further alleged that one of the injured namely Chandru, sustained grievous injuries resulting in permanent loss of vision in one eye. Hence, a case was registered and the petitioner was arrested.

3.The learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody since 15.12.2025 and that he has not having any previous case pending against him. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the injured persons are still in hospital. He further submitted that the injuries sustained are grievous in nature and that one of the injured has permanently lost vision in one eye. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the nature of the allegations, the fact that one of the injured has suffered permanent loss of vision, and that the petitioner has one previous 2/4

case pending against him and that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
