CRIME NO.1 OF 2021 For Petitioner : M/S.S.NAGARATHINAM Advocate For Respondent : MR.S.KARTHIKEYAN, ADDITIONAL PUBLIC PROSECUTOR PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 341, 324 and 506(ii) of IPC, in Crime No.1 of 2021, seeks anticipatory bail.
2. Totally there are accused in this case and the petitioner is A2. It is alleged that the petitioner along with A2 attacked and abused the defacto complainant who is a 90 years old lady, thereby, she sustained grievous injuries and admitted in the hospital. Hence, the complaint.
3. The learned counsel for the petitioner submitted that due to previous enmity the defacto complainant has lodged a false complaint against the petitioner. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioner along with with A2 attacked and abused the defacto complainant who is a 90 years old lady. He would further submit that the the petitioner also filed a anticipatory bail before the learned principal District and sessions Judge, Chennai in Cr.M.P.No.100 of 2021 and the same was dismissed. Hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the fact and circumstances of the case and the nature of offence committed by the petitioner and the earlier application was dismissed by the Court below, this Court is not inclined to grant anticipatory bail to the petitioner.
