1.Mahalingam 2.R.Krishnan 3.The New India Assurance Company Ltd., rep.by its Branch Manager, 114, Main Road, Nellikuppam-607105 ..Respondents Though the case is not listed today, it is taken up for settlement at the instance of both the parties. The learned counsel for the appellant, Mr.S.Sounthar is present. The learned counsel for the 3rd respondent Mr. S. Manohar is present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs. 68,000/- with interest at 7.5% p.a. from the date of petition till the date of deposit as compensation.
2. Not satisfied with the award of the Tribunal, the claimant/appellant has preferred the present appeal for enhancement. Now the parties mutually agreed to settle for a enhanced sum of Rs. 90,000/- (Rupees Ninety Thousand Only) in full quit over and above the amount awarded by the Tribunal.
3. The 3rd respondent/Insurance Company is directed to deposit the modified award amount within a period of six weeks from the date of receipt of a copy of this order, after deducting the amount already deposited, if any. On such deposit, the appellant is permitted to withdraw the entire award amount. Award is modified accordingly.
4.The Tribunal is directed to issue the cheques to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.
